Terms and Conditions

Version 1.3, 3 October 2026. Plain English, no legal padding. Toflin is a trading name of Anthony Flynn.

The main points

  • We work with businesses, not consumers. These terms are between you (the business) and Toflin.
  • You agree by ticking the box at checkout and paying, or by signing an Order Form. Either one counts as signing.
  • Every product has its own schedule with the price, what is included and how to cancel.
  • Websites: paid once, upfront. Year one covers the build and 12 months hosting. After that, hosting is £20 a month or £199 a year.
  • Social Media and Ads: we never post or run anything without your approval. You pay ad spend direct to the platform.
  • We cannot guarantee leads, sales, followers or rankings. Nobody honest can.
  • This summary is only a guide. The full terms below are what count.

General terms (apply to every order)

1. About these terms

1.1These terms are between Toflin, a trading name of Anthony Flynn, a sole trader (“we”, “us” or “Toflin”), and the business named on your order (“you”).

1.2You can contact us at hello@toflin.co.uk, on 01698 598763, or by post at 13 Clyde Street, Carluke, ML8 5EF.

1.3We sell to businesses only. By ordering, you confirm that you are buying for the purposes of your trade, business or profession, and not as a consumer.

1.4These General Terms apply to every order. Each product also has its own Schedule at the end. Schedule 1 covers the Website packages (Landing Page, 5 Pages + Landing Page and Launch Package), hosting and Monthly updates. Schedule 2 covers Social Media (Audit, Kickstart, Foundation, Rolling and Growth). Schedule 3 covers Ads (Single, Five and Ten). If a Schedule and these General Terms disagree, the Schedule wins for that product.

1.5Together, these General Terms, the Schedule for your product and your order (the online checkout or a signed Order Form) make up the contract between us.

2. Making an order

2.1You can order through one of our online payment links or by signing an Order Form. The contract starts when we accept your order. For an online order, that is when your payment goes through. For an Order Form, it is when we have both signed.

2.2Ticking the box to accept these terms at checkout and then paying has the same effect as signing this contract. We keep a record of your acceptance.

2.3You confirm that the details you give us are correct, and that the person placing the order has the authority to commit your business.

2.4We can turn down an order before we start work. If we do, we will refund anything you have paid.

3. Prices and payment

3.1The price is the price shown on toflin.co.uk or on your order at the time you order. Toflin is not VAT registered, so no VAT is added.

3.2You pay through Stripe, using the payment methods offered at checkout. We do not see or store your card details.

3.3Subscriptions renew automatically each billing period until they are cancelled under the Schedule for your product.

3.4If a payment fails, our payment provider will try again. If it is still unpaid 7 days after it was due, we can pause the service until it is paid. Your Schedule says what happens if payment stays missing. You must also pay interest and our reasonable recovery costs on late payments, as allowed by the Late Payment of Commercial Debts (Interest) Act 1998.

3.5Offers and discounts, such as the Founding Customer offer, apply only to the products and dates stated on the site or your order at the time you order. They are not backdated and cannot be combined unless we say so in writing.

3.6For ongoing services, we can change the price by giving you 30 days’ written notice. You can cancel before the new price starts without any extra charge, and any minimum term under your Schedule stops applying. If you have already paid in advance for a period, the price stays the same until that period ends.

3.7Except where your Schedule says otherwise or the law requires it, once work has started, payments are not refundable.

4. Our services

4.1We will provide our services with reasonable skill and care.

4.2Dates and timescales are our best estimates unless your Schedule gives a fixed timescale. They can slip if we are waiting on you for information or approval.

4.3We may use other people or tools (for example designers, hosting, scheduling tools) to deliver our services, but we stay responsible to you for them.

4.4We can improve or change how we deliver our services as long as they do not get worse for you. If we need to make a change that matters to you, we will tell you first.

4.5We do not guarantee results. Enquiries, sales, search rankings, followers and reviews depend on many things outside our control. We will do the work properly, but we cannot promise any particular outcome.

5. What we need from you

5.1You will give us the information, photos, logo, wording and approvals we ask for, promptly and accurately.

5.2You confirm that you own, or have permission to use, everything you send us. That includes logos, photos and text, and it includes permission from any customer or person who appears in a photo or whose home, vehicle or property is shown. It must not break anyone else’s rights or mislead anyone.

5.3You must hold any registration, accreditation, licence or insurance that you say you hold (for example Gas Safe, NICEIC, TrustMark or trade body membership), and what we publish about it for you must be true and up to date.

5.4If we are waiting on you for more than 30 days, we can pause the work. Anything you have already paid stays non-refundable, except as your Schedule says.

5.5We will not publish anything on your behalf, on social media, in ads or elsewhere, without your approval. You are responsible for checking that what you approve is correct.

6. Who owns what

6.1Your logos, photos, text and other materials stay yours. You give us permission to use them to provide the services while the contract runs.

6.2Once a website or social media piece is finished, we may show it as an example of our work, unless you ask us in writing not to.

6.3Our templates, code, tools, know-how and the underlying framework of anything we build stay ours. You may use them as part of the service, for as long as the contract runs and you are up to date with payment, unless your Schedule says otherwise.

6.4Your Schedule says what you own of the work we create for you.

6.5Some stock images, fonts and plugins are licensed to us by other companies. They can only be used on the site or account we provide them for.

7. Third-party services and your accounts

7.1We rely on services run by other companies, such as Stripe, Meta (Facebook and Instagram), Google, domain registrars and hosting providers. Their terms and fees apply. They can change or suspend things without asking us, and we are not responsible for what they do. Ad spend is paid by you direct to the platform. It is not part of our fees.

7.2Your Facebook page, Instagram account, Google Business Profile, ad accounts and similar accounts stay yours. You will keep an administrator on each of them, and give us the access we need. When the contract ends, we remove our own access. You are responsible for keeping your own logins secure.

8. Data protection

8.1Each of us will follow the UK GDPR and the Data Protection Act 2018.

8.2We use your details to provide the services, take payment and stay in touch with you. Our privacy policy at toflin.co.uk/privacy-policy explains how.

8.3Where we handle personal information about your customers for you, for example enquiries sent through your website or reviews we help you collect, we only do so on your instructions and to provide the services. We keep it secure, and delete it or hand it back to you when the contract ends. You are responsible for making sure you can lawfully collect it and for telling people how you use it.

9. Ending the contract

9.1How you cancel, and what notice you need to give, is set out in the Schedule for your product. To cancel, email hello@toflin.co.uk from the address on your order. We will confirm within 2 working days.

9.2Either of us can end the contract straight away by written notice if the other person seriously breaks it and does not put it right within 14 days of being told in writing, or if the other becomes insolvent. We can also end it straight away if you do not pay, or if you break clause 5.2 or 5.3.

9.3When the contract ends, you must pay anything already due. Your Schedule says what happens to your website, domain and accounts.

9.4Ending the contract does not affect rights either of us already has. Clauses that are meant to carry on after the end (payment, ownership, data, liability and governing law) do so.

10. Our responsibility to you

10.1Nothing in this contract limits our responsibility for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law of Scotland does not allow us to limit.

10.2Subject to clause 10.1, we are not liable for loss of profit, business, contracts, revenue, goodwill or anticipated savings, or for any indirect loss (loss that is not the direct and obvious result of our breach).

10.3Subject to clause 10.1, our total liability to you for everything arising out of a contract is limited to the fees you paid us under that contract in the 12 months before the claim arose.

10.4We are not liable for loss caused by third-party platforms or hosting failures outside our control, by your materials or instructions, or by you not following our reasonable advice.

11. Events outside our control

11.1Neither of us is in breach of the contract for a delay or failure caused by something outside our reasonable control, such as power or internet failures, platform outages, severe weather, or serious illness or emergency affecting us. This does not excuse a failure to pay money that is due.

12. General

12.1These terms, your Schedule and your order are the whole agreement between us and replace anything said or written before. This does not limit liability for fraud.

12.2We may update these terms for future orders. Existing contracts stay on the terms you agreed, except for changes the law requires, changes that help you, or changes we tell you about with 30 days’ notice for ongoing services (you can cancel before they start).

12.3Notices must be in writing. Email is fine. We will use the email address on your order, and you should use hello@toflin.co.uk.

12.4You cannot transfer the contract to anyone else without our written agreement. We may transfer it to another business that takes over Toflin, as long as we tell you and your service does not get worse.

12.5If part of these terms turns out not to be enforceable, the rest still applies.

12.6Nobody else has any right to enforce this contract.

12.7If you are unhappy with anything, email hello@toflin.co.uk. We will reply within 5 working days and do our best to put it right.

12.8This contract is governed by the law of Scotland, and the courts of Scotland have exclusive jurisdiction over any dispute.

Schedule 1: Website packages, hosting and Monthly updates

This Schedule applies to the Landing Page, the 5 Pages + Landing Page and the Launch Package, to hosting for those websites, and to the Monthly updates add-on.

S1.1What is included. Landing Page: one focused page built around a single offer, designed to send ad or social traffic to. 5 Pages + Landing Page: five pages plus a landing page. Launch Package: a six page website, built and written for you; a brand pack (logo, colours, fonts, business card, letterhead, quote template and email signature designs); Google Business Profile set up; Facebook and Instagram artwork; branded post templates and one month of posts written and designed; the first month of those posts scheduled for you, then handed over to you; and a 12-month marketing blueprint. Printing costs are not included. Every package includes 12 months of hosting from go-live.

S1.2Price and payment. Each package is paid in one payment, when you order and before we start work. Your first payment covers the build and the first 12 months of hosting. The prices are the ones shown on toflin.co.uk or on your order at the time you order. You can pay by any method offered at checkout.

S1.3Founding customer offer. Orders placed by 31 December 2026 get the founding price shown on toflin.co.uk: £299, £499 or £1,599. From 1 January 2027 the full prices are £399, £799 and £2,999. The offer does not apply to hosting or Monthly updates.

S1.4How the build works. We build from the information and materials you give us and show you a draft. We revise it with you until you are happy, before anything goes live. Revisions cover what is in your package. Extra pages, sections or features are extra, and we will tell you the price first. We will give you an estimated go-live date when you order.

S1.5Hosting. Hosting keeps your website live. It includes hosting, security and software updates, and a monthly check that your site is working as it should. Hosting does not include changes to your site. Changes are charged at £35 each, for up to 30 minutes of work per change, and we will tell you before we start if a change will take longer. Bigger jobs, like a new page or a redesign, are quoted first.

S1.6Monthly updates. Monthly updates is an optional add-on, paid yearly in advance. It includes everything in Hosting, plus up to 1 hour of changes to your site each month, such as new photos, prices, services or wording. Unused time does not carry over to the next month and is not refunded. Anything beyond 1 hour in a month is charged at £35 per 30 minutes, and we will tell you first.

S1.7Renewal. Hosting is required to keep your website live. It is included for the first 12 months. After that you pay £20 a month or £199 a year, whichever you choose. Monthly updates, if you have it, is £395 a year. We will email you at least 30 days before your first hosting payment. Monthly hosting has a minimum term of 12 months. After 12 months you can cancel by email before your next payment date, and the site goes offline at the end of the month you have paid for.

S1.8If hosting is not renewed or paid. If hosting is not renewed, or a renewal payment is still unpaid 7 days after it was due, we can take your site offline. If it is still unpaid 30 days after it was due, we can end the contract. If you pay later, we will put the site back live if we still hold it.

S1.9Refunds and cancelling. You can cancel for a full refund before we start work. Once work has started, the payment is not refundable. Yearly hosting and Monthly updates are paid a year at a time, and we do not refund part years. Monthly hosting is paid a month at a time and cannot be cancelled in the first 12 months.

S1.10Launch Package extras. The Launch Package includes a discount code for 20% off the first 3 months of any Social Media or Ads package. It must be used within 6 months of your site going live, it applies to our fees only (not ad spend), and it cannot be exchanged for cash. The marketing blueprint is a plan for you to follow. After the first month, posting is your responsibility unless you buy a Social Media package.

S1.11What you own. When you have paid in full, you own the text, logo and design work we created specifically for you (including the brand pack in the Launch Package). We keep ownership of the underlying code, themes, plugins, templates and tools. You may use them as part of your site while your hosting is paid up.

S1.12Your domain and email. We register one standard domain in your name and set up one email address for you. We cover their cost up to £50 a year in total, for as long as your hosting is paid. Anything above that, such as a premium domain, extra email addresses, Google Workspace or Microsoft 365, is charged at cost, and we will agree it with you before we buy it. We buy domains one year at a time. If you already have a domain, you keep paying your current provider and we connect it to your site. If you leave, the domain stays yours and you pay for it from then on.

S1.13If you leave. We take your site offline at the end of the hosting period you have paid for. If you have paid everything you owe, we will give you a copy of your site and its content on request within 30 days of the end, apart from any plugin, theme or image that is licensed to us and cannot be passed on.

S1.14Existing customers. If you ordered a website package before these terms were updated, on a one-off build fee with monthly hosting, your existing terms (version 1.1) continue to apply to that order.

S1.15Introductory social media offer. This clause applies only to the 3 businesses that claimed our introductory Landing Page offer through our Facebook or Instagram posts. Instead of the yearly price, you pay £50 setup, then £25 a month for hosting and management, starting on the day your site goes live, for a minimum of 12 months (£350 in year one). After 12 months it rolls on month by month until you cancel. Cancel by email before your next payment date, and it ends at the end of the month you have paid for. If you cancel during the first 12 months, the monthly payments up to the end of month 12 are still due. Changes are £35 each (up to 30 minutes). Clauses S1.4, S1.5, S1.11, S1.12 and S1.13 also apply. If a monthly payment is still unpaid 7 days after it was due, we can take the site offline until it is paid.

Schedule 2: Social Media

This Schedule applies to the Social Media Audit, Kickstart, Foundation, Rolling and Growth.

S2.1Social Media Audit. £50 one-off. We look at your Facebook and Instagram pages and give you three specific things to fix. It is paid in advance.

S2.2Kickstart. £395 one-off. We set up your Facebook and Instagram properly, optimise your Google Business Profile, install a review system and create and schedule your first 8 posts. It is paid in advance.

S2.3Foundation. £885 a quarter, paid in advance. This includes 8 posts a month across Facebook and Instagram, before-and-after content from your photos, the Review system running continuously, and a monthly summary.

S2.4Rolling. £395 a month. The same as Foundation, with no quarterly commitment. You can cancel at any time.

S2.5Growth. £1,485 a quarter, paid in advance. This includes 16 posts a month across three platforms, stories and short-form video, Google and Meta ads managed for you, and a quarterly results review with you in person or by video. For the ads part of Growth, clauses S3.2 to S3.6 and S3.10 of Schedule 3 also apply, and you pay the ad spend direct to the platform. Payment and cancelling for Growth follow this Schedule, not Schedule 3.

S2.6Approval. We will not post anything until you have approved it. If you have not approved a post in time, we will not publish it. Posts missed because you have not approved them are not carried over or refunded.

S2.7Photos and content. You send us photos and information when you can, and we do the rest. If a photo shows a person, someone’s home, a vehicle or a number plate, you confirm you have the right to use it (see clause 5.2 of the General Terms).

S2.8Your accounts. Your pages and accounts stay yours. You add us as an administrator or partner and keep at least one administrator of your own. We do not buy followers or likes, and we do not use bots. Platforms can change their rules, restrict a page or suspend an account, and we are not responsible for that.

S2.9Reviews. The review system helps you ask real customers for real reviews. We do not write, buy or edit reviews for you, and you must not either. The law on fake reviews applies to both of us, as do the rules of Google and Meta.

S2.10Google Business Profile. Your Google Business Profile stays yours. Google can change or suspend it, or make its own edits, and we are not responsible for that.

S2.11Foundation and Growth: payment and renewal. Each quarter is paid in advance and renews automatically at the end of the quarter. To stop it renewing, give us notice by email at least 7 days before the renewal date. We do not refund part of a quarter.

S2.12Rolling: cancelling. Give us notice by email before your next payment date. Your service carries on to the end of the month you have paid for, then stops. We do not refund part months.

S2.13Audit and Kickstart: refunds. Because we start work straight away, the Audit and Kickstart are not refundable once we have started. Before we start, you can cancel for a full refund.

S2.14Changing package. You can move to a different Social Media package from the start of your next billing period, by emailing us.

S2.15Results. We do not guarantee any number of enquiries, followers, reviews or sales.

S2.16Founding customer offer. If you sign up to Foundation, Rolling or Growth by 31 December 2026, you pay 50% of the price in this Schedule for your first 6 months (two quarters for Foundation and Growth, six monthly payments for Rolling). After that, the full price in this Schedule applies, and we will email you at least 30 days before it changes. Kickstart ordered by 31 December 2026 is 50% off. The Social Media Audit is not discounted.

Schedule 3: Ads

This Schedule applies to the Single Ad, Five Ads and Ten Ads. Clauses S3.2 to S3.6 and S3.10 also apply to the ads part of Social Media Growth.

S3.1What you get. Single Ad, £150 a month: one advert, built and managed for you, running on one channel (Facebook or Instagram). Five Ads, £495 a month: up to five adverts running at once, on one channel, tested against each other so the best one wins, and refreshed as jobs and seasons change. Ten Ads, £995 a month: up to ten adverts running at once, across both channels (Facebook and Instagram), with full testing across audiences and creative, and refreshed as jobs and seasons change. Every package includes the ads being written, targeted and monitored, and a monthly summary of what they brought in.

S3.2Ad spend. Ad spend is not part of our fee. You pay it direct to the platform, from your own ad account. We will agree a monthly budget with you in writing (an email is fine), and we will not set budgets above it. You stay in control of your budget and can pause or change your ads in your own account at any time. We are not responsible for what the platform charges.

S3.3Your ad accounts. You own your ad account and your business page. You add us as a partner or administrator so we can manage the ads, and you keep at least one administrator of your own.

S3.4Approval. You approve every advert before it runs, and any big change to an advert before it goes live.

S3.5Platform rules. Meta and Google review ads before and after they run. They can reject, limit or stop an ad, or restrict an account, and we are not responsible for that.

S3.6Truthful ads. Everything in an ad must be true. You are responsible for the claims, offers, prices and accreditations you ask us to use. We can refuse to run an ad we think is misleading or unlawful, including under the advertising rules.

S3.7Payment. Our fee is paid monthly in advance and renews each month until you cancel.

S3.8Cancelling. You can cancel at any time. Give us notice by email before your next payment date. We stop managing your ads at the end of the month you have paid for. We do not refund part months. If you want your ads to stop earlier, ask us or pause them yourself in your account. Ad spend is charged by the platform until the ads are switched off.

S3.9Changing package. You can move up or down a package from your next billing date. If you want to move up sooner, email us and we will agree it.

S3.10Results. We do not guarantee any number of enquiries, any cost per enquiry or any sales. Results depend on your budget, the season, your competitors and the platform.
